Probate is the "Proving of a Will" as the last will and testament of the deceased. Probate enforces and determines issues in a decedent's estate. This includes resolving conflict, deciding which beneficiaries receive which assets and overseeing the process to distribute the estate assets. Probate costs - Probate fees by statute of the State of California are based on the GROSS value of your estate and range from 4% - 7%. Ex. $26,000 for a $500,000 estate - $46,000 for a $1,000,000 estate PLUS probate court filing fees - http://www.scscourt.org/documents/fee_schedules/FeeSchedule.pdf PLUS probate referee costs (.001 of gross estate value), PLUS real estate appraiser estimated at $500 per property PLUS local newspaper notices estimated at $100's, (required notices) = thousands of dollars over statutory probate fees!
Probate process - There is no uniform process that applies to all situations but the basics can be found here - http://www.courts.ca.gov/8865.htm. It is clear that the twists and turns for each situation drives up the cost and complexity at a time when a family is mourning the passing of a loved one. Especially at this time, it is devastating to experience this draining process with never-ending costs. It is complicated and can be AVOIDED with an estate plan.
